I am not a solicitor and not legally trained, however I do have some experience taking companies to court successfully .
My experience says that you could each individually take nissan to the small claims court to recover the cost of a new engine. This will cost under £100 and has the real potential to get you your money back. Nissan would send a representative to answer the case in county court, but it would be up to the judge to decide if you should be paid or not. You could theoretically all lodge your claim at the same time and the court could opt to hear all the cases together.
Option 2 would be to form a collective group and find a solicitor who would work on a no win no fee basis. This would be protected by an insurance policy to protect you from costs. It would be necessary to sue for damages as well as actual costs to make this viable. Dependent upon the number in your group costs could be as small as about £100 again. Nissan would be forced to supply proper evidence to defend the claim, but it is highly likely they would lose.

Encouraging news How do all the other members feel about this way?I,m all for it and the sooner the better. We need some kind of engineers report to strengthen our case .I was reading a blogg on 4x4 the other night back in 06 that gave a specific reason for the engine failures .How can it be added to our site Nik? we all need to talk about this I,m here -weenib@hotmail.com or 01851 710287 Ps I,ve had e-mails from australia and the same thing is happening to our down under brethern A site like this one is being set up there and they are looking to us for advice and support We all need to get to knoweachother and do some plotting and planning ,otherwise we,re wasting our time

Hi all not been back online for a while but had my nav fixed and have the broken con rod (no 2). Bent the crank also. My no 07970000045. Can get pictures if needed. My mechanic says it's a manufacturing fault. Also friend of mine has had timing chain snap same mechanic fixing at mo. I'm in cheers martin

Good News Martin It is imperative that your mechanic gives you a report and that you have pictures These will be of great help in the coming court case Ask for report on your friends too These can be presented to the sherriff or magistrate which will greatly strengthen our case .Im sure we will all be pleased at your news Thanks for your support Well done

Hi just had engine replaced I have the offending piston and Engine block although it would appear they were going to reuses block and had cleaned it up etc but also have the crankshaft awaiting engineers report lets fight them 07774 273420

count me in tapping noise 02 plate with 82000 full nissan service history bought second hand from private seller.. now full rebuild will take pics whe i split her open. is legal action happening? as would be happy to share my experience its cost me over £500 in parts without labour. arp bolts and new end shells etc not sure if the con rods are weak tho so il see what it look like tom surrey 07904 432 836

HI Just joined, my engine blow 71000 dealer who I got car second hand July 07 claimed not to know about issues. just cost me 3,500 for engine. I have read that Nissan sent letters out to owners anyone get one.
